End User License Agreement

This End User License Agreement (“EULA”) is a legal agreement between you (the “user” or “licensee”) and ZORDON INTELLIGENCE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (“Licensor”) for the mobile application Hotfork (“the App”). By downloading or using the App, you agree to be bound by this EULA.

1. Scope

This EULA applies to the free iOS application Hotfork published on the Apple App Store. It supplements the Apple Licensed Application End User License Agreement (“Apple Standard EULA”), which is incorporated by reference and available at apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict, the mandatory terms of the Apple Standard EULA prevail.

2. Licence grant

The Licensor grants you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded products you own or control, for your personal use. You may not: copy, sell, rent, lease, lend, or sublicense the App; reverse-engineer, decompile, or attempt to derive the source code, except as permitted by law; remove or alter any proprietary notice; or use the App in any manner not expressly permitted.

3. Access to third-party services

The App communicates with GitHub’s public API. You are solely responsible for complying with GitHub’s terms of service when you use the App, and the App’s availability depends on third-party services outside the Licensor’s control.

4. Intellectual property

The App, including its source code, graphics, design, and documentation, is the property of the Licensor or its licensors and is protected by copyright and other intellectual-property laws. All rights not expressly granted are reserved.

5. Data and privacy

The App collects no personal data and stores your bookmarks on your device. Our Privacy Policy, available at /privacy, explains how little data the App touches. It applies to your use of the App.

6. No warranties and limitation of liability

The App is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. In no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the App. Because the App is free of charge, the Licensor’s aggregate liability is limited to the fullest extent permitted by applicable law.

7. Termination

This EULA remains in effect until terminated. It terminates automatically if you breach its terms. You may terminate it at any time by deleting the App. The provisions that by their nature survive termination (including licence limitations, disclaimers, and exclusions of liability) shall survive.

8. Governing law

This EULA is governed by the laws of the Republic of Poland, without regard to conflict-of-law principles. Any dispute not subject to the exclusive jurisdiction of Polish courts shall be resolved by the competent courts of Poland, without prejudice to mandatory consumer-protection rules.
